General Terms & Conditions
Welcome to the Team EF Coaching Affiliate Program. This policy outlines the terms and conditions of participation in our program. By joining our affiliate program, you agree to comply with these terms and any updates we may make.
1. Program Overview
The Team EF Coaching Affiliate Program allows approved affiliates ("you", “You” or "Affiliate") to earn commissions by promoting our products and services through your unique affiliate link.
2. Eligibility
To participate in the program, you must:
· Be at least 18 years old.
· Operate a valid website, social media account, or marketing platform.
· Comply with all applicable laws and regulations.
Team EF Coaching reserves the right to reject applications for any reason at our sole discretion.
3. Affiliate Obligations
Promotion: You may promote our products using approved materials provided by Team EF Coaching or your own materials, provided they are accurate and do not misrepresent our brand or products.
Compliance: Affiliates must adhere to:
· All applicable advertising laws and disclose their affiliate relationship in compliance with the Federal Trade Commission (FTC) guidelines or equivalent laws in your jurisdiction.
· The Code of Conduct set forth in Exhibit A.
· The Disclosure Requirement set forth in Exhibit B.
Prohibited Practices: Affiliates may not:
· Use spam, unsolicited emails, or unauthorized ads.
· Misrepresent our brand or products.
· Use paid search ads that bid on Team EF Coaching trademarks.
4. Commission Structure
Rates: Affiliates earn the following commission rates based on the product category:
· Coaching 1-1 (Essentials, Core and Premium programs): 3%
· Camps: 3%
· Foundations training plan: 20%
· Skills Academy: 20%
Qualifying Sales: Sales are attributed to your account if the customer completes a purchase using your affiliate link within 90 (ninety) days.
Payouts: Commissions are paid via Kajabi or PayPal on a quarterly basis, provided you meet the minimum payout threshold of USD $50 (USD fifty).
Adjustments: Commissions will not be paid on cancelled orders, refunds, or chargebacks.
5. Termination and Suspension
Termination by You: You may terminate your participation at any time by notifying us in writing.
Termination by Team EF Coaching: We may terminate your participation immediately for violations of this policy or inactivity for more than 60 (sixty) days.
Post-Termination: Upon termination, any unpaid commissions will be forfeited if they result from violations of this policy.
6. Limitations of Liability
Team EF Coaching will not be liable for indirect, incidental, or consequential damages arising from your participation in the affiliate program. Our total liability for any claim under this agreement is limited to the amount of commissions paid to you.
7. Confidentiality
Affiliates must keep all non-public information about Team EF Coaching and the affiliate program confidential, including performance metrics and proprietary marketing materials.
8. Program Modifications
We reserve the right to modify the terms, commission rates, or structure of the affiliate program at any time. Affiliates will be notified of changes via email or the affiliate dashboard, and continued participation constitutes agreement to the updates.
9. Governing Law; Arbitration
This policy shall be governed by and construed and enforced in accordance with the laws of the State of Massachusetts, without giving effect to the conflict of laws rules thereof.
Any dispute, claim or controversy arising out of or relating to this policy or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this policy to arbitrate, shall be determined exclusively by arbitration in Wilmington, Delaware, before a single arbitrator in accordance with and administered by JAMS pursuant to its Streamlined Arbitration Rules & Procedures. Judgment on the arbitration award may be entered in any court having jurisdiction.
This clause shall not preclude the parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction, including an action for specific performance or injunctive relief. The prevailing party in any such arbitration or court action to enforce arbitration shall be entitled to recover expenses incurred, including attorneys’ fees. The arbitration must be on an individual basis. This means neither the Affiliate nor Team EF Coaching may join or consolidate claims in arbitration by or against other contractors or litigate in court or arbitrate any claims as a representative or member of a class or in a private attorney general capacity.
This section shall survive any expiration or termination of this policy.

By participating in the Team EF Coaching Affiliate Program, you acknowledge that you have read, understood, and agreed to this policy.
EXHIBIT A – CODE OF CONDUCT
1. Compliance: Affiliates must follow all Team EF Coaching policies and instructions, including removing content upon request.
2. Honesty: Affiliates must provide truthful opinions about Team EF Coaching products/services. If opinions change, notify Team EF Coaching.
3. Claims: Any statements must be accurate, typical, and substantiated. Misleading or unapproved claims are prohibited.
4. Prohibitions: Affiliates must not:
· Guarantee financial success, defame, or impersonate Team EF Coaching.
· Publish unlawful, abusive, misleading, or defamatory content.
· Use copyrighted material or unauthorized media.
· Engage in cookie stuffing, deceptive behaviors, or software manipulation.
· Send unsolicited emails, spam, or violate advertising laws.
5. Content Standards: Avoid offensive content, hate speech, or illegal promotions. Do not post pornography, profanity, or depictions of violence.
6. Affiliate Links: Use and share affiliate links responsibly; self-referrals are prohibited.
7. Advertising: Paid campaigns must comply with this policy. Prior approval is required for contests or incentives.
8. Responsibility: Maintain and update content; honor requested changes from Team EF Coaching.
9. No Imitation: Do not copy or mimic Team EF Coaching’s branding or website design.
EXHIBIT B – DISCLOSURE REQUIREMENTS
Affiliate represents, warrants and agrees to comply with the following guidelines for all content created on Team EF Coaching’s behalf:
1. Material Connections: Affiliates must disclose any material benefits (e.g., payment, gifts, discounts) received from Team EF Coaching.
2. Clarity & Visibility: Disclosures must be clear, easy to understand, and prominently displayed in all content, regardless of format.
· Acceptable examples:
o “#ad”
o “Sponsored by Team EF Coaching”
o “I am a paid affiliate marketer for Team EF Coaching.”
· Unacceptable examples:
o Ambiguous hashtags (e.g., #spon, #collab)
o Solely tagging Team EF Coaching or using platform-branded tools.
3. Platform-Specific Rules:
· Social Posts: Disclosures must appear in the first two lines or prominently at the start of captions.
· Videos: Include disclosures within the video and in descriptions.
· Stories & Live Streams: Overlay disclosures on visuals and repeat during streams as needed.
4. Tools: Use platform-specific tools (e.g., “Branded Content”) as supplemental, not standalone, disclosures.
